1. About Us
Hope It Passes ("we", "our", "us") is a trading name of Datapass Ltd (company number 17238226), registered in England and Wales. By accessing or using hopeitpasses.com (the "Site") or any related services (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Services.
2. MOT History and Probability Service
We provide statistical estimates of MOT pass probabilities and vehicle history insights based on publicly available DVSA data. To use this service you will enter a Vehicle Registration Mark ("VRM"), which we use to retrieve the associated MOT history from DVSA records.
Our estimates are not guarantees of any future MOT outcome. The Service is informational only. We are not a garage, vehicle inspector, or authorised testing facility, and nothing on this Site constitutes mechanical or safety advice. We are not liable for any repair costs, MOT failures, or vehicle purchase decisions made in reliance on our data.
We also offer a data API for business customers ("B2B API"). Use of the B2B API is subject to a separate API agreement entered into at the point of access.
3. Fuel Price Service
We provide a free fuel price comparison service ("Fuel Price Service") based on publicly available data sourced from the UK government's fuel price reporting scheme. This data is licensed under the Open Government Licence v3.0.
3.1 Accuracy and No Warranty
Fuel prices displayed are sourced from third-party government data feeds and are updated periodically. We do not warrant that prices are accurate, current, complete, or error-free at any given moment. Actual prices at the forecourt may differ. You rely on fuel price information at your own risk. We accept no liability for any loss, cost, or inconvenience arising from reliance on fuel prices displayed on the Site.
3.2 Service Availability
The Fuel Price Service is provided free of charge. We reserve the right to modify, suspend, or discontinue it at any time, with or without notice, for any reason including data feed interruptions, maintenance, or commercial decisions. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service.
3.3 Fuel Price Predictions
We may from time to time offer fuel price forecasts, predictions, or trend analysis. These are statistical estimates only, based on historical and current data. They are not financial, commercial, or investment advice. We accept no liability whatsoever for any decision made in reliance on any fuel price prediction or forecast provided through the Site. Predictions may be wrong and past price trends are not a reliable indicator of future prices.
3.4 Fuel Price Alerts
You may register an email address to receive notifications when local fuel prices change ("Fuel Price Alerts"). By registering for Fuel Price Alerts you agree that:
- We may use your email address to send you fuel price alerts and related service updates.
- Where you have given explicit consent at the point of registration, we may also send you marketing communications from us and share your email address with selected automotive sector partners for their own marketing purposes.
You may unsubscribe from alerts or withdraw any marketing consent at any time by emailing gdpr-opt-out@hopeitpasses.com.
4. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
- Scrape, harvest, or systematically extract data from the Site without our written consent.
- Attempt to reverse-engineer, decompile, or copy any part of the Site or its underlying software.
- Introduce viruses, malware, or other harmful code.
- Use the Services to send unsolicited commercial communications.
- Misrepresent your identity or affiliation.
We reserve the right to suspend or terminate your access immediately if you breach these acceptable use requirements.
5. Intellectual Property
All intellectual property rights in the Site, its software, design, content, algorithms, predictive models, and compiled datasets are owned by or licensed to Datapass Ltd. Nothing in these Terms grants you any rights in that intellectual property other than the limited right to access and use the Services for your own personal, non-commercial purposes (or, for B2B customers, as set out in your API agreement).
DVSA MOT data and government fuel price data are published under the Open Government Licence v3.0. Our analysis, presentation, and derived datasets remain our intellectual property.
6. Data and Consent to Commercialisation
Where you voluntarily provide data through our forms and explicitly consent to do so, you grant us permission to:
- Aggregate and anonymise vehicle usage data (e.g. mileage, failure rates by component, fuel price search patterns) and use it in our statistical models, published reports, and commercial products. Aggregated and anonymised data is not personal data.
- Share your contact details (email address, postcode) with selected third-party partners in the automotive sector (such as warranty providers, insurance brokers, and garages) for marketing purposes — but only where you have given your explicit, informed consent to that specific type of sharing at the point of collection.
VRMs you enter are used solely to retrieve MOT history data and are not shared with third parties for marketing purposes.
You may withdraw consent for third-party sharing at any time by emailing gdpr-opt-out@hopeitpasses.com. Withdrawal of consent does not affect the lawfulness of any sharing that took place before you withdrew it.
7. Disclaimer and Limitation of Liability
All Services are provided "as is" and "as available" without warranty of any kind, express or implied. This applies to the MOT Probability Service, the Fuel Price Service (including fuel price alerts and predictions), the B2B API, and any other feature of the Site.
To the fullest extent permitted by law, Datapass Ltd excludes all liability for:
- Loss of profits, revenue, or anticipated savings.
- Loss of data or corruption of data.
- Indirect, consequential, or special loss.
- Any repair costs, purchase decisions, or financial loss arising from reliance on our estimates.
- Any loss arising from inaccurate, delayed, or unavailable fuel price data.
- Any loss arising from reliance on fuel price predictions or forecasts.
- Any loss arising from interruption, suspension, or discontinuation of any Service.
Where we cannot lawfully exclude liability (for example, for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation), we do not do so. Nothing in these Terms affects your statutory rights as a consumer.
To the fullest extent permitted by applicable law, we exclude all liability arising out of or in connection with these Terms or the Services. Where liability cannot be excluded by law, it is limited to £1.
8. Changes to These Terms
We may update these Terms from time to time. Where changes are material, we will provide at least 30 days' notice by posting an update on the Site or (where we hold your email address) by email. Continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.
9. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to your rights as a consumer to bring proceedings in your local court.

1. What Data We Collect
- Vehicle Registration Mark (VRM): Entered by you to look up MOT history. A VRM can identify the registered keeper and is therefore personal data under UK GDPR.
- MOT history and vehicle data: Mileage, test results, defect records — retrieved from DVSA open data using the VRM you provide.
- Contact data you choose to provide: Email address and postcode submitted via forms (e.g. for fuel price alerts, marketing opt-ins, or B2B enquiries).
- Technical data: IP address, browser type and version, device type, referring URL.
- Usage data: Pages visited, VRM search queries, fuel search queries, feature interactions, session duration.

3. Third-Party Sharing
We may share your data with:
- Automotive sector partners (warranty providers, insurance brokers, garages) — only where you have given explicit, informed consent at the point of collection. This applies to both MOT service opt-ins and fuel price alert registrations. You may withdraw this consent at any time.
- Service providers acting as data processors on our behalf, including cloud hosting providers, analytics services, and email delivery platforms. These processors are bound by data processing agreements and may not use your data for their own purposes.
- Law enforcement or regulatory bodies where we are required to do so by law.
VRMs you enter are not shared with third parties for marketing purposes. We do not sell personal data in the sense of transferring it in exchange for money.
4. International Transfers
We aim to store and process your personal data within the United Kingdom. Where any of our service providers transfer data outside the UK, we ensure that appropriate safeguards are in place (such as the UK's International Data Transfer Agreement or equivalent adequacy protections) in accordance with UK GDPR requirements.

6. Your Rights
Under UK GDPR you have the right to:
- Access — request a copy of the personal data we hold about you.
- Rectification — ask us to correct inaccurate or incomplete data.
- Erasure ("right to be forgotten") — ask us to delete your data where there is no overriding legitimate reason for us to keep it.
- Restriction — ask us to pause processing of your data in certain circumstances.
- Portability — receive your data in a structured, machine-readable format and transfer it to another controller.
- Object — object to processing based on legitimate interests; you have an absolute right to object to direct marketing.
- Withdraw consent — where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of prior processing.
